Sign up! New improved Assured Tenancy Agreement [CDS tenants only]

CDS Co-operatives have revised their assured tenancy agreement. This is to take account of changes in the law which has increased tenants’ rights.

Tenancy agreements can no longer have unfair terms, known as unfair terms of contract; this is where certain conditions of the tenancy are left to the landlords’ discretion. Landlords must clearly state what are the conditions of tenancy and the circumstances in which action will be taken against tenants who break the conditions of the tenancy.

The Housing Act 1988 makes provision for landlords to grant the tenant the right to assign their tenancy to a member of the household who would have been entitled to succeed to the tenancy in the event of the tenant’s death – provided that they have lived with the tenant for the last 12 months.  CDS have introduced this clause into the new assured tenancy agreement.
